A potential scandal involving the University
of New Hampshire ’s Survey
Center is developing. The UNH
pollsters may have been paid by the Manchester Union Leader and the Hearst-owned
WMUR-TV to rig 2014 election poll results to “erase” the name of a major
candidate who could be running second in other independent but unknown polls.
U. S. Senate candidate Andy Martin has given the University
of New Hampshire until May 27th to
explain its actions and relationship with the tainted media outlets.

participation in media fraud
Dear Mr. Smith:
When a private entity commits fraud or aids and abets in a
scheme or artifice to defraud, such behavior is a serious legal matter. When a state
university participates in fraud or a scheme or artifice to defraud that is a
civil rights violation. State agencies are obviously held to higher standards than
private entities.
When a state conducts what is otherwise a private business
activity, such as providing services for a private entity (by conducting a
“poll”) the state does not lose its status as a public actor.
For some time I have suspected that the Survey
Center is “cooking the books” in
the 2014 U. S. Senate Republican Party primary.
I was planning to send you a letter indicating a lawsuit was
imminent, when something got me to write today. While Twitter is hardly a
source that would support a dissertation, a lot of truth sometimes slides
through the cracks on Twitter, and reaches the sunlight. Someone claims to have
seen polls placing me second in the senate primary (see below).
Recently you were quoted as saying there were only “four”
senate candidates. [http://www.examiner.com/article/survey-points-to-rough-going-for-n-h-democrats]
That’s the lie used by the clowns at the Union Leader and
the Hearst Family’s TV station to drive down my poll numbers and exterminate my
campaign. Obviously your “three candidates” number is a lie, and you know it. So
why were you lying? “Erasing” a legitimate
candidate for federal office is a serious civil rights violation.
I am the only anti-Brown candidate who has been using any
broadcast advertising for several months. A Suffolk
University poll found me at the
lower end the responses, but still alive and moving. And you say I don’t exist?
It appears to me that you have been manipulating your poll
results to further the fraudulent intent of both the Hearst Family and the
McQuaid Family. Instead of being a servant of the truth, New
Hampshire ’s leading public university has become a
valet of the wealthy.
One reason to file a lawsuit would be to expose all of your
sampling information and the parameters you used to conduct your “polls.” Also,
I suspect that your “clients” are asking you to pretend my candidacy does not
exist. A private party can lie; a state actor cannot participate in such a
fraudulent scheme.
The law always favors the settlement of disputes. While I am
always prepared to litigate, litigation is a last resort. I prefer to settle
disputed claims.
Please carefully review your posture and get back to me no
later than Tuesday, May 27th. I will take no action until then.
